JOB SUMMARY
In collaboration with the Pinal County Human Resources Department and under the direction of the Pinal County Manager’s Office, the Professional Responsibilities Office (PRO) was established to foster a culture of integrity and promote the highest standards of professional conduct.

The PRO Deputy Director is responsible for managing a varied caseload of complex administrative investigations involving alleged violations of County policy and/or law regarding harassment, discrimination, retaliation, related misconduct, and other serious misconduct warranting the involvement of specialized investigative staff. 

The PRO Deputy Director provides significant assistance and input to the director, influencing decisions that direct the department's operations, including complex administrative investigations and the drafting/revising of Pinal County Policies and Procedures and Merit System Rules. In the director's absence, the deputy director oversees department operations and assumes decision-making responsibilities for the Professional Responsibilities Office.

This position is not covered under the Pinal County Merit System. Incumbents in this position serve at the pleasure of their respective Appointing Authority. The employment relationship of incumbents in this position is "at will," i.e., the employee may be terminated at any time, for any reason, with or without cause.

TYPICAL CLASSIFICATION ESSENTIAL DUTIES

  • Conducts thorough, prompt, and equitable administrative investigations involving sensitive and complex issues.
  • Conducts in-depth legal research regarding the elements necessary to prove certain allegations, including consulting relevant policies, laws, regulations, and administrative guidance.
  • Develops investigation plans to identify allegations and issues, applicable policies and laws, relevant evidence, and scope of investigations. Performs core investigative tasks, including interviewing witnesses, gathering relevant records, evaluating and analyzing evidence, conducting credibility assessments, and making factual findings.
  • Drafts professional, well-analyzed, well-research, comprehensive reports that summarize the investigation and prepares other documents of organizational and legal significance.
  • Ensures timely, appropriate communication with all parties and stakeholders regarding investigations.
  • Reports findings to the appropriate authorities within the County.
  • May be required to testify in court and before boards, commissions, and similar like bodies relative to activities or areas of responsibility.
  • Provides assistance to department leaders, supervisors, and staff in the interpretation of county policies and procedures, the processing of employee concerns and grievances, and the handling of complex administrative investigations.
  • Participates in County policy review, revision, development, and drafting process to maintain current and legally compliant policies and procedures.
  • Drafts comprehensive, sensitive management reports involving workplace culture assessments for County departments as needed.
  • Oversees daily operations and assumes decision-making responsibilities for the Professional Responsibilities Office when the Director is absent.
  • Represents the director and/or the department at formal and informal meetings.
  • Develops presentations and trainings for elected officials, executives, directors, managers, supervisors, employees, and constituents regarding County policies, merit rules, applicable state and federal employments laws, and best practices for managers and supervisors.
  • Promotes and adheres to the workplace values of accountability, commitment, and teamwork to help enrich lives beyond expectation.
  • Maintains absolute confidentiality of work-related issues, customer records, and restricted County information.
  • Performs other related duties as required.

MINIMUM REQUIREMENTS TO PERFORM WORK

  • Juris Doctor, Master of Public Administration, Master of Business Administration, or comparable graduate degree.
  • Five (5) years of professional experience conducting investigations and drafting complex investigation reports or comparable administrative reports, significant legal memorandums, or motions for summary judgment.
PREFERRED QUALIFICATIONS:
  • Juris Doctor.
  • Demonstrated knowledge of Arizona and federal employment laws.

KNOWLEDGE, SKILLS, AND ABILITIES

  • Knowledge of federal and state statutes, laws, principles, and practices relating to employment law, policies, and procedures.
  • Knowledge and demonstrated understanding of due process principles.
  • Knowledge of Human Resources best practices.
  • Knowledge of laws and statutes governing the release of public records and information.
  • Knowledge of principles and practices relating to records management.
  • Knowledge of developments, practices, and technology in administrative investigations.
  • Skill in using critical thinking to spot relevant issues
  • Skill in identifying, analyzing, and weighing relevant evidence and in drawing sound conclusions in complex investigations and other matters.
  • Exceptionally skilled in legal writing with the ability to draft concise, well-analyzed reports.
  • Skill in interpreting and applying case law, statutes, regulations, rules, and administrative guidance documents.
  • Skill in collecting, processing, and analyzing data.
  • Skill in negotiating and coordinating changes to the merit system rules and county policies and procedures.
  • Ability to analyze administrative problems throughout the County.
  • Skill in developing management-level training and presentations.
  • Skill in presenting management-level trainings and presentations.
  • Ability to conduct complex legal research necessary to revise and draft policies and procedures.
  • Ability to revise and draft well-written policies and procedures.

PHYSICAL DEMANDS

The work is light and requires exerting up to20 pounds of force occasionally, and/or, up to 10 pounds of force to move objects. The work also requires the ability to finger, feel, grasp, handle, perform repetitive motion, kneel, lift, pull, push, speak, hear, move, operate motor vehicles and demonstrate visual and mental acuity.
